This is not stubbornness. And China is beating the US at its own game – outpacing us and the rest of the world in key areas of technological advancement. The CCP understands that the 21st century will be a highly innovative country that can harness the full power of new technologies.
For decades, that nation was undoubtedly the United States. But in the last two decades, China has grown dramatically. investing in research and development; Cut to America’s cultural hegemony. Cost-effectiveness is not the only measure. The United States is losing the talent battle — and the trend lines are getting worse. China has consistently graduated more STEM PhDs than the United States.

Clearly, the US is going to destroy our technological edge at a time when protecting our national interests is more important than ever. To compete with China, we must innovate China. Policymakers must act urgently to change the policy environment in ways that protect and promote American innovation. Unfortunately, recent policy changes have done the opposite.
FTC Chairwoman Leena Khan proposed. Clearing new laws that prevent employers from using unilateral non-compete agreements – something California has done. This puts employers in highly competitive, trade secret-rich sectors — artificial intelligence, biotechnology and precision manufacturing — and puts the United States at odds with China.
Regulation must be eliminated, and Congress must engage in pursuing other regulatory measures that undermine American innovation without a vote by elected officials.
Meanwhile, Supreme Court decisions have made it impossible to enforce patents in certain fields, thereby discouraging investment in critical industries. China, by contrast, appears willing to patent certain technologies that are subject to much uncertainty regarding patent rights in the United States. This puts American innovators at a significant competitive disadvantage in critical emergent areas.

This is a problem that Congress can fix. Sen. Tom Tillis, R-N.C., introduced the Patent Eligibility Restoration Act (PERA), which would clarify patent eligibility for key innovation categories, including biotechnology and artificial intelligence — and provide American inventors with a more stable, predictable patent eligibility environment. .
Such an explanation is especially important when it comes to artificial intelligence, where China’s stake is probably the highest. Regulatory foot-dragging has led to uncertainty about what AI-powered (or AI-generated) inventions are patentable, putting American innovation at risk. Without clear guidance, the current pace of progress could slow — with far-reaching consequences for our military readiness and the broader economy.
Meanwhile, administrative procedures at the US Patent and Trademark Office are creating headaches and even worse problems for inventors seeking to protect their patents. A quasi-judicial administrative body within the USPTO — the Patent Trial and Appeal Board, or PTAB — has become a popular forum for challenging the validity of patents that companies are accused of infringing. This hurts inventors and small businesses who must simultaneously defend their IP in court and the PTAB, reducing the incentive to invent in the first place.

The good news is that America has a proven track record of defeating authoritarian regimes in strategic technological competition. But we didn’t beat the Soviet Union to the moon by accident. It requires a generation of investment in cutting-edge research and development that will help Americans solve the most pressing technical problems of their time.
The ability of American citizens to solve the technical problems of our time is equally unmatched. But the priorities of our government are not aligned with the challenges of the time. That must change, or the Chinese Communist Party will be poised to win in the future.
